ARTICLE I

Apartment House and Condominium Complexes

§ 71-1. Purpose.

 

  The purpose of these rules and regulations is to protect the safety, health, comfort and general welfare of residents and their property by regulating parking on the interior streets, roadways, parking areas and driveways in private apartment house complexes and private condominium complexes where congested parking may prevent passage of fire-fighting equipment, in accordance with the provisions of § 1640-a of the Vehicle and Traffic Law.

 

 

 

 

§ 71-2. Fire zones.

 

  The areas designated under Chapter 145, Zoning, for multifamily dwelling units, townhouses, apartments or condominiums or the areas where nonconforming multiple residences exist and in which there are interior streets, roadways, parking areas and driveways shall be designated as fire zones.

 

§ 71-3. Restricted areas.

 

  The Board of Trustees of the Village of Lansing is hereby empowered to designate certain portions of fire zones as restricted areas. Parking of motor vehicles in said restricted areas is hereby prohibited. Vehicles parked or abandoned in said restricted areas may be removed by towing at the direction of the Board of Trustees or its designee or at the direction of the owner and/or persons in charge of the operation and control of such area at the expense of the owner of the vehicle. Notwithstanding and not in limitation of any other provision hereof, no motor vehicle shall be parked within twenty (20) feet of any fire hydrant, standpipe or sprinkler connection located at, on or near an interior street, roadway, parking area or driveway within any premises designated as a fire zone under the provisions of this Article.

 

§ 71-4. Signs and markings.

 

  Such restricted areas shall be marked with standard police signs and markings indicating that said area is a restricted fire zone and subject to towing. Signs and markings shall be purchased from the Village by the owner at his expense. Said owner shall promptly pay to the Village Treasurer the actual cost thereof. Upon failure to purchase and install said signs after thirty (30) days' written notice to the owner of the property or his authorized agent, the Village may install the signs and bill said owner. The owner of the property or his authorized agent may, as an alternative, authorize the Village in writing to install said signs and markings when needed and to bill said owner for the cost of said signs and their installation.  Upon failure to pay the Village Treasurer the cost of said signs and their installation, the cost shall be assessed against said owner as additional taxes due to the Village. 

 

§ 71-5. Pre-existing designations.

 

  Any areas within private apartment house complexes or private condominium complexes which prior hereto have been designated or marked as fire zones or restricted areas within fire zones, pursuant to the authority of the Village of Lansing, shall continue to be so designated with the full force and effect of this Article. Such areas, the owners thereof and all other individuals shall be bound by all terms and provisions of this Article.

 

 

 

 

 

 

§ 71-6. Enforcement.[1]

 

  Any peace officer or parking enforcement officer duly authorized to perform his or her duties within the Village of Lansing shall administer and enforce the provisions of these rules and regulations, and for such purpose shall have the authority to issue appearance tickets pursuant to Article 150 of the Criminal Procedure Law. Appearance tickets may require payment by mail of a designated fine or appearance in the Justice Court of the Town of Lansing and shall be in such form as may be prescribed by the Town Justice of the Town of Lansing.

 

§ 71-7. Penalties for offenses.

 

  Enforcement hereof and the penalties to be imposed shall be in accordance with § 1800, Subdivision (b), of the Vehicle and Traffic Law.

 

 

ARTICLE II

Shopping Centers

§ 71-8. Purpose.

 

  The purpose of these rules and regulations is to protect the safety, health, comfort and general welfare of the residents and their property by regulating parking on the interior streets,  roadways,  parking areas and  driveways  in shopping centers within the Village of

Lansing where congested parking may prevent passage of fire-fighting equipment, in accordance with the provisions of § 1640-a of the Vehicle and Traffic Law.

 

§ 71-9. Fire zones.

 

  The interior streets, roadways, driveways and parking areas of all shopping centers within the Village of Lansing shall be designated as fire zones. For the purposes hereof, the interior streets, roadways, driveways and parking areas of such shopping centers shall be defined as follows: An area or areas of private property totaling at least one (1) acre, near or contiguous to and provided in connection with premises having one (1) or more stores or business establishments, and used by the public as a means of access to and egress from such stores and business establishments and for the free parking of motor vehicles of customers and patrons of such stores and business establishments.

 

§ 71-10. Restricted areas.

 

  The Board of Trustees of the Village of Lansing is hereby empowered to designate certain portions of fire zones as restricted areas.
