§ 94-1. Designation of spaces.

 

      A.     The Village of Lansing shall designate as it deems appropriate certain parking spaces or areas within the Village as parking for handicapped persons. Such areas are to be used exclusively by vehicles bearing either a special parking permit issued by a municipal agent pursuant to § 1203-a of the Vehicle and Traffic Law, or special license plates and registration issued by the Department of Motor Vehicles pursuant to § 404-a of the Vehicle and Traffic Law and only when such vehicles are being used for the transportation of a severely handicapped or disabled person as defined by § 404-a, Subdivision 4, of the Vehicle and Traffic Law.[1]

B.           Such special parking spaces or areas for handicapped persons shall include those spaces or areas designated for such purpose by the owner or person in general charge of the operation and control of parking areas, driveways and private roads of shopping centers, apartment house complexes, fire stations or private condominium complexes, provided that such owner or person in charge of the operation and control of such areas has requested in writing that such spaces or areas be designated by the Village as parking spaces or areas for handicapped persons pursuant to the provisions of this chapter.

C.          Handicapped parking spaces or areas governed hereunder shall be designated by the posting of signs declaring such spaces or areas for use by handicapped persons.

 

§ 94-2. Authority to remove improperly parked vehicles.

 

  When any vehicle is found improperly parked, stopped or standing in a parking space or area which has been designated pursuant to this chapter by the property owner or the Village of Lansing as a parking space for handicapped persons, said vehicle may be removed by the Village of Lansing.

§ 94-3. Determination of improperly parked vehicle.[2]

 

  A vehicle shall be deemed improperly parked in such an area or space when the vehicle bears neither a parking permit issued under § 1203-a of the Vehicle and Traffic Law, nor a special license plate and registration issued under § 404-a of the Vehicle and Traffic Law or when a vehicle bearing one (1) of the above is not being used for the transportation of a severely handicapped or disabled person as defined by § 404-a, Subdivision 4, of the Vehicle and Traffic Law.

 

§ 94-4. Removal and redemption of improperly parked vehicles.

 

  After removal of any vehicle as provided hereunder, the Village of Lansing may store such vehicle in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle may redeem the vehicle upon payment to the Village of Lansing of the amount of all expenses actually and necessarily incurred in effecting such removal. The Village of Lansing shall, without delay, report the removal and the disposition of any vehicle removed as provided hereunder to the County Sheriff and it shall be the duty of such County Sheriff to ascertain to the extent possible the owner of the vehicle or person in charge of the vehicle and notify such person of the removal and disposition of such vehicle and of the amount which will be required to redeem such vehicle.
